Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Lyv platform ("Service"), operated by Lyv ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use Lyv. By using the Service, you confirm that you meet this requirement and that the information you provide is accurate and complete.
2. Description of Service
Lyv is an AI-powered personal health system that generates personalised protocols across fitness, nutrition, supplements, lifestyle, and mindset. All plans are generated by artificial intelligence based on information you provide. The Service is for informational and personal planning purposes only. 3. Free Trial
We offer a 7-day free trial for new subscribers. During the trial period, you will not be charged. If you do not cancel before the end of the 7-day trial, your subscription will automatically commence and your nominated payment method will be charged at the applicable rate.
4. Subscription and Billing
- Subscriptions are billed monthly in Australian Dollars (AUD).
- The current rates are A$79/month (Founder rate, available to the first 50 subscribers) and A$149/month (Standard rate).
- The Founder rate is locked for the lifetime of your subscription, provided it remains active and in good standing.
- Billing is processed securely via Stripe. We do not store your full payment details on our servers.
- Subscriptions renew automatically each month unless cancelled.
5. Cancellation
You may cancel your subscription at any time through your account portal. If you cancel during your free trial, you will not be charged. If you cancel after your trial has ended, you will retain access to the Service until the end of your current billing period. No partial refunds are issued for unused portions of a billing period, except where required by Australian Consumer Law.
6. Refunds
Except as required under the Australian Consumer Law, all payments are non-refundable. If you believe you are entitled to a refund under Australian Consumer Law, contact us at support@thelyvapp.com.
7. Your Account
You are responsible for maintaining the security of your account credentials. You must not share your account with others. We reserve the right to terminate accounts that violate these Terms.
8. Health Information and Blood Work
You may choose to upload blood work or pathology results to enhance the personalisation of your protocols. This information is used solely to generate your health protocols within the Service. We do not sell or share your health data with third parties for commercial purposes. You may export or delete your data at any time.
9. Acceptable Use
You agree not to misuse the Service. This includes attempting to access other users' data, reverse-engineer the platform, or use the Service in any way that violates applicable laws or regulations.
10. Intellectual Property
All content, design, and software comprising the Lyv platform are owned by or licensed to us. Your personalised health protocols are generated for your personal use and are not to be redistributed or commercialised.
11. Disclaimers and Limitation of Liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability to you in any circumstance is limited to the amount you paid us in the 3 months preceding the claim.
Nothing in these Terms is intended to exclude or limit rights you have under the Australian Consumer Law that cannot be excluded.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
